1. Introduction
Welcome to PesaShip.com, an escrow-based digital payment platform operated by Deen Investment Co. Ltd. (“we”, “our”, or “us”). These Terms and Conditions govern your access and use of our website, mobile application, and related services. By registering or using PesaShip, you agree to comply with these Terms.

 

2. Definitions
  • “Buyer” means any user purchasing goods or services using PesaShip.
  • “Seller” means any user selling goods or services through PesaShip.
  • “Escrow Account” means a temporary holding account where buyer funds are stored until completion of a transaction.
  • “Transaction” means any payment initiated via PesaShip between a buyer and seller.
  • “User” means any individual or entity registered on the PesaShip platform.

 

3. Acceptance of Terms
By accessing or using PesaShip, you agree to these Terms. If you do not agree, you must not use our services. We may revise these Terms from time to time, and your continued use of PesaShip constitutes acceptance of the updated Terms.

 

4. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts under Tanzanian law. Businesses must provide valid registration documents and contact information.

 

5. How PesaShip Works
  1. Buyer selects a Seller and initiates payment via PesaShip.
  1. PesaShip holds the funds securely in escrow until the buyer confirms goods or services are received as agreed.
  1. Once confirmed, funds are released to the Seller.
  1. In case of a dispute, PesaShip mediates following the Dispute Resolution Policy.

 

6. Fees and Charges
  • PesaShip may charge a service fee or commission per transaction.
  • All fees will be disclosed before payment confirmation.
  • Fees are non-refundable once a transaction is completed.

 

7. User Responsibilities
Users agree to:
  • Provide accurate information during registration and verification (KYC).
  • Use the platform for lawful purposes only.
  • Not engage in fraudulent, deceptive, or illegal activities.
  • Maintain confidentiality of their account credentials.

 

8. Prohibited Activities
Users must not use PesaShip to:
  • Launder money or finance terrorism.
  • Transact illegal goods or services.
  • Misrepresent product quality or delivery status.
  • Manipulate or interfere with PesaShip systems.

 

9. Intellectual Property
All PesaShip trademarks, logos, software, and content are owned by Deen Investment Co. Ltd. and protected under Tanzanian intellectual property laws. You may not reproduce, distribute, or exploit any material without written consent.

 

10. Limitation of Liability
PesaShip shall not be liable for any indirect, incidental, or consequential damages resulting from your use of our services. We do not guarantee uninterrupted access to our systems or third-party integrations.

 

11. Suspension or Termination
We may suspend or terminate user accounts for violations of these Terms, suspected fraud, or misuse of services.

 

12. Dispute Resolution
Disputes will be handled in accordance with the PesaShip Dispute Resolution Policy, beginning with mediation and, if unresolved, arbitration under Tanzanian law.

 

13. Governing Law
These Terms are governed by and construed in accordance with the laws of the United Republic of Tanzania.
